Mosley är det faktiskt så att vill man stämma i USA för något som publicerats på nätet måste man registrerat det som ett US work för att kunna stämma någon för copyrightintrång i USA. Eller som domstolen sa "Thus, although "registration is not a condition of copyright protection," see id. § 408(a), registration (or a refusal of registration) of a United States work "is a prerequisite for bringing an action for copyright infringement," BUC Int'l Corp. v. Int'l Yacht Council Ltd., 489 F.3d 1129, 1142 (11th Cir.2007). The plaintiff bears the burden of proving compliance with statutory formalities. Latimer v. Roaring Toyz, Inc., 601 F.3d 1224, 1233 (11th Cir. 2010)."
Ett verk ses som ett "United States work" om det är först publicerat "simultaneously in the United States and another treaty party or parties" eller "simultaneously in the United States and a foreign nation that is not a treaty party" och t.o.m. "in the case of a pictorial, graphic, or sculptural work incorporated in a building or structure, the building or structure is located in the United States."
